## Özet

**President of Üsküdar University Psychiatrist Prof. Nevzat Tarhan participated in the “Children Drawn into Crime” panel, organized by the Lawyers' Association and hosted by Boğaziçi University, with the theme of “Justice, Protection, and Responsibility.” Tarhan gave a presentation titled “A Medical Perspective on Children Drawn into Crime.” Pointing out that there has been a significant increase in child psychiatry cases with digitalization and the pandemic, Tarhan stated that factors such as lack of early intervention, domestic neglect and abuse, and impulsivity are effective in leading to crime. Expressing that morality is a learned value, not innate, Tarhan emphasized that today's children are growing up without a moral compass. Tarhan also noted that weak authority in education, incorrect parenting attitudes, and the 'project child' approach pose risks, highlighting the importance of raising children based on values, producing not only intelligent and successful but also benevolent individuals. **

President of Üsküdar University Psychiatrist Prof. Nevzat Tarhan spoke in the second session titled “A New Perspective on the Child Criminal Justice System: Balance of Sanction and Protection.”

The session was moderated by Attorney Hacer Kılıçarslan, Head of the Lawyers' Association Youth Commission. Also present at the session were Istanbul University Faculty of Law Assoc. Prof. Muhammet Demirel and Istanbul Anadolu Courthouse Public Prosecutor Assoc. Prof. Cengiz Apaydın.

## **“When follow-up is weak, the problem becomes chronic…”**

Speaking in the second session titled “A New Perspective on the Child Criminal Justice System: Balance of Sanction and Protection,” President of Üsküdar University Psychiatrist Prof. Nevzat Tarhan addressed the 3T rule in medicine. Tarhan began his words by saying; “I especially thank the Lawyers' Association for bringing such an important and sensitive issue to the agenda. Because if we do not diagnose correctly, we cannot treat correctly. So, the important thing is to make the correct diagnosis. In medicine, there is the 3T rule: Diagnosis, Treatment, and Follow-up. As a nation, we diagnose, and even if we treat, our follow-up remains weak. Many problems become chronic because of this, and we cannot solve them. ”

## **“Child psychiatry clinics are receiving more cases than ever before”**

Stating that digitalization has increased psychiatric cases, Tarhan said; “Child psychiatry clinics are receiving more cases than ever before. Cases of behavioral disorders, cases of violence against parents, cases of substance abuse… Previously, it wasn't enough to open a separate clinic. It could be resolved with outpatient treatment, but now the pandemic and digitalization have had an accelerating effect. The family ceasing to be a safe space also plays a significant role here. ”

## **“Most of these cases are preventable”**

Stating that the concepts related to children should be defined correctly, Tarhan said; “From a medical perspective, children drawn into crime are not bad or criminal, but rather developmentally hindered, traumatized, at risk, or untreated. In fact, most of these cases are preventable. Because intervention could not be made, and they remained untreated, preventable cases could not be prevented. Therefore, it is not the child who commits a crime, but the child being driven into crime... It is necessary to define this concept correctly here: the child driven into crime, the child led into crime. ”

## **Is morality genetic?**

Referring to the global increase in incidents of violence, Tarhan said; “In Article 31 of the Turkish Penal Code, medical evaluation literature has focused on certain issues in children directed towards crime. What is the perception and guidance ability of these children? A child psychiatrist, in cooperation with a forensic medicine specialist, determines with a medical report whether the child perceives the legal meaning and consequences of the act committed. Is he aware of what he is doing or not? This person cannot distinguish right from wrong, good from bad. When children make a decision or do something, they first need to learn the boundaries of these three concepts: good-bad, right-wrong, and limits of freedom. This is a learned thing, not genetic. That's why morality is not genetic. It is always said that there is no need to teach morality. What was Adam Smith's thesis in bringing liberalism to light? There is a protective hand that regulates the market, and the market has no morality. Capitalism started this way. It started with 'the market has no morality,' and then wild capitalism emerged. Marxism, which was a reaction to it, emerged. Later, an attempt was made to achieve a balance with social democracy, but after the 90s, the way for wild capitalism was opened again. So, the increase in violence, the global increase in violence, is not a simple matter.&rdquo;

## **“Teacher's authority in schools has weakened considerably”**

Stating that class leadership should be with the teacher, Tarhan said; “Currently, the teacher's authority in schools has weakened considerably. This is a situation that needs to be questioned here. Class leadership should be with the teacher. Currently, there is a tendency to lose class leadership, school leadership, to parents. There is a populist approach here, and it is very dangerous. A parent with attention deficit hyperactivity also glorifies their child in such situations and seems to want the world to revolve around their child. ”

Speaking about the importance of early intervention in children drawn into crime, Tarhan said; “Impulsivity is the most common diagnosis in children drawn into crime. For example, such children see an iron bar, pick it up, throw it onto the road, and do the first thing that comes to their mind. It is a condition characterized by behavioral disorder, lack of empathy, and disregard for rules. If not intervened early, it leads to antisocial personality. In the future, individuals skilled in crime, without a sense of compassion, antisocial people emerge. A significant portion of those currently in prison are antisocial personalities. Beyond the antisocial person, there is a personality called the 'dark triad,' which is a newly defined toxic personality. Narcissism, antisociality, and Machiavellianism all together. A narcissistic person has a big ego and personal goals, trying to do everything for them, but a narcissist still knows where to stop. A manager can be narcissistic and have some traits, knowing the limit, but when antisociality enters, they do not comply with social norms and can easily lie. When Machiavellianism enters, they say, 'Everything is permissible to achieve the goal,' and this is considered the most malicious personality, most prone to crime. ”

## **“The vast majority are victims of trauma…”**

Referring to victims of trauma and neglect, Tarhan said; “Looking at the studies in the last 5 years on substance use disorders, the rate of being drawn into crime with synthetic drug use is between 40 and 60 percent. This is also an important statistic. Here, perpetrators emerge from victims in trauma and neglect. Medical literature reveals that the vast majority of children drawn into crime are actually victims of trauma. Victims of trauma, meaning these children experience trauma in their own childhood, model that trauma, try to do the same themselves, and have a history of abuse. Neglect and abuse in the family during childhood. These include physical abuse, physical neglect, emotional abuse, emotional neglect, and sexual abuse…”

## **“The child sees himself as the leader of the house”**

Explaining the consequences of raising 'project children,' Tarhan said; “If we look at the example in the Kahramanmaraş incident, when we examine how a child was raised, the child was raised as a 'project child.' We do not know the case in full, but since it has become public, we need to draw some lessons. A child raised in such a situation becomes the boss of the house until the age of 11-12, the child is raised as the leader of the house. Special attention is given as if they were a special child whose every wish is granted. The child is very successful and has 'islands of genius' in their brain. They have learned languages spontaneously, do many things, know computers, speak, and parents and everyone admire the child. The child increasingly sees himself as the leader of the house. However, after the age of 11-12, the child inevitably socializes. New hormones appear in their body, and they enter society. Friends start saying no to what the parents say yes to. Everyone in society says no to them. There are parents who grant every wish. What happens to the child in such a situation? They suffer terribly. They say, 'How can someone like me be told no? How can I be treated wrongly?' Here, what we call fragile narcissism emerges. They suffer, and they develop a feeling of harming those who harm them, seeking revenge, saying, 'I am right, everyone else is wrong, we live in an unjust system.'&rdquo;

## **“Children are growing up without a moral compass”**

Referring to the change in the child-rearing model, Tarhan concluded his words by saying; “We have lost our child-rearing model, the model related to our ancient values. As a result of losing this, children are growing up without a moral compass. They are growing up having lost their values compass. Consequently, here we have children who are intelligent, hardworking… An intelligent, hardworking, successful chemical engineer produces synthetic cannabis. An intelligent, hardworking, successful computer engineer becomes a hacker. He finishes medical school and forms a newborn gang. This means that being intelligent and hardworking is not enough. A third parameter is needed, and that is the parameter of being benevolent.&rdquo;
