## Özet

[**Üsküdar Üniversitesi**](https://uskudar.edu.tr/)** organized a panel that addressed the topic of “Migration and Refugee Status in the Context of Human Rights.” Psychiatrist Prof. Dr. Nevzat Tarhan pointed out that due to the fast-paced global life in the 21st century, virtual migrations have begun, stating, “Today, the format of migration has changed a bit. There is a virtual universe called Metaverse. Everyone will enter a virtual world of computers with their own identity. A database with blockchains will be formed there. People will shop, walk the streets, have fun, spend and save their bitcoins there. This is also a form of migration. Now there is digital migration.” Tarhan also underlined the concepts of empathy and migration psychology.**

Üsküdar Üniversitesi and the Human Rights and Equality Institution of Turkey (TİHEK) organized the Panel on Migration and Refugee Status in the Context of Human Rights, where the phenomenon of migration, one of today's most important issues, was discussed within the framework of human rights.

## **Prof. Dr. Ebulfez Süleymanlı: “Serious human rights violations are experienced during and after migration”**

Prof. Dr. Ebulfez Süleymanlı, Head of the Sociology Department at Üsküdar Üniversitesi and moderator of the panel held online within the scope of pandemic measures, stated that as a university, they address the problems faced by migrants and refugees from different dimensions every year, adding, “In today's panel, we will evaluate migrant and refugee issues in the context of human rights. The relationship between migration and human rights is quite complex and multidimensional. Especially when examined at the international level, serious human rights violations occur during and after migration.”

## **Prof. Dr. Nevzat Tarhan: “Human rights are the truth and new sacred of this era”**

** **Prof. Dr. Nevzat Tarhan, Founding Rector and Chairman of the Executive Board of Üsküdar Üniversitesi, stated that addressing human rights and the Equality Institution alongside migration is a very important matter. He said, “When we research the psychology of migration, we can say that its biggest traumatic effect is on humans. Human rights are not like clothing, but like skin. Just as skin is what makes a person human, human rights are also important. There is no statute of limitations for crimes related to human rights. Human rights are the truth and sacred of this era.”

## **Prof. Dr. Nevzat Tarhan: “Turkey hosts the most asylum seekers in the world”**

Prof. Dr. Nevzat Tarhan, ‘In the USA, you won’t get a big reaction if you tear the flag, but you will face a serious reaction if you say you are against human rights,’ said, and continued his words as follows:

“Europe has moved from a period of fascist oppression with the church and feudal lords to a point where people seek freedom. Culturally, they understand its value very well. They value many rights such as freedom, the fundamental right to life, the right to travel, the right to a fair trial, the right to practice one's religion, and the right to appeal to the judiciary and justice. Despite having such rights, they struggled to escape slavery. In a situation where human rights are so important, migration significantly affects human rights because it is a traumatic experience. It is a situation that directly touches people. There is also a terminology for it. Refugee, asylum seeker, and migrant concepts are evaluated separately. In the case of a migrant, there is a voluntary migration. A refugee is someone who has sought asylum and been granted accepted status. An asylum seeker is someone awaiting acceptance from the country they have sought refuge in. Currently, there is a large number of asylum seekers in Turkey. Turkey hosts the most asylum seekers in the world who have not yet attained refugee status. We have shown a tolerance and approach that the world's superpowers have not.”

## **Prof. Dr. Nevzat Tarhan: “Turkish culture has the ethics of Ansar and Muhajir”**

Emphasizing that Turkish culture possesses the ethics of Ansar and Muhajir, Prof. Dr. Nevzat Tarhan said, “As is known, the Muhajir were forced to migrate from Mecca, and it became the Hijra. Hijra is also considered the beginning of the Islamic calendar. Hijra is a very important historical event, but also a very serious trauma. They were forced to migrate from the places where they lived and grew up. They changed many of their habits, comfort, and safe areas. They turned to a new world, a new life, and new relationships. In migrations like the Crimea migration, many people lost their lives, and a significant part of these migrations turned into genocide. In such situations, showing sensitivity to protecting human rights is very important. That is why TİHEK's emphasis on this issue is very valuable.”

## **Prof. Dr. Nevzat Tarhan: “Empathy must be established with people experiencing migration”**

Tarhan stated that it is easy to make statements like 'Let them go back to where they came from' in public squares, adding, “They are human after all. They have children, families. They cannot meet many basic human rights and needs. The basic needs of a human are food, drink, and shelter. If one can sit comfortably while there are people who cannot meet all these, then this is selfishness. In the context of empathy, the most important topic to discuss is the psychology of migration. Regardless of the reason and form, it is necessary to establish empathy with people experiencing migration. When we establish this empathy, the adaptation of migrants and, when possible, their return to their homelands will be easier.”

## **Prof. Dr. Nevzat Tarhan: “Hz. Mevlana also experienced forced migration with his family”**

Pointing out that migrations throughout history have brought about both traumatic effects and opportunities, Prof. Dr. Nevzat Tarhan continued his words as follows:

“There have been major waves of migration in the world. There were forced migrations from Africa. Currently, not all of the black population in America are natives. There are people abducted from their countries and enslaved. There is also significant migration in the European population now. We can say that Anatolia is the biggest migration crossroads. Anatolia has an amazing genetic pool. All genes have come and merged in Anatolia. This geography has hosted all migrants. Today is the last day of Hz. Mevlana Commemoration Week. For example, Mevlana also migrated. Balkh, his birthplace, was a very protected city with a fortress. Following the Mongol attacks, by his father's decision, Mevlana and his family were forced to migrate from their home when Mevlana was 10 years old. After Mecca, Medina, Damascus, Baghdad, and Erzincan, they settled in Karaman. After Karaman, they went to Konya. This is a tremendous migration. Mevlana emerged during this migration process. If he had stayed in Balkh, perhaps Mevlana would not have emerged. Most of those who came to Anatolia came through migrations. Most of our ancestors are people from Khorasan and that region.”

## **Prof. Dr. Nevzat Tarhan: “Virtual migrations began in the 21st century”**

Stating that migration is more widespread and accepted in cultures that lived on horseback, Prof. Dr. Nevzat Tarhan said, “In the 21st century, because there is a fast-paced global life, there are now virtual migrations. Today, the format of migration has changed a bit. There is a virtual universe called Metaverse. Everyone will enter a virtual world of computers with their own identity. A database with blockchains will be formed there. People will shop, walk the streets, have fun, spend and save their bitcoins there. This is also a migration. Now there is digital migration. There are people who meet from different countries and get married in Turkey. This is also a migration brought by technology and mobility. All of these have sociological and psychological ramifications. Migration affects people's fundamental rights and mental health, causing social changes. In such situations, those who take the right position catch up with innovation. Those who take the wrong position remain in the dustbin of history.”

## **Yılmaz Bölükbaşı: “3 million 739 thousand 240 Syrians are temporarily living in our country”**

** **Yılmaz Bölükbaşı, Vice President of TİHEK, provided detailed information about the institution's work in the field of human rights. Yılmaz Bölükbaşı stated that as of December 2021, 3 million 739 thousand 240 Syrians are temporarily living in our country, adding, “In addition to these, there are a total of 5-5.5 million foreign migrants in our country, including what we call conditional refugees or persons under secondary protection.” Bölükbaşı stated that when migration, asylum, and human trafficking are mentioned, a bird with a broken wing comes to mind, and continued, “The institution monitors all rights and freedoms specified in the constitution, international conventions, and legislation concerning these birds with broken wings, i.e., vulnerable individuals.” Yılmaz Bölükbaşı said that they primarily work on the basis of respect for the family unity and family life of migrants and refugees.

## **Assoc. Prof. Dr. Arzu Güler: “Asylum is an institution of protection that states will provide if they wish”**

** **Assoc. Prof. Dr. Arzu Güler from Aydın Adnan Menderes Üniversitesi evaluated the right to asylum as a human right in the context of international law. Assoc. Prof. Dr. Arzu Güler defined the right to asylum as “the right to request asylum in other states and to benefit from the possibility of asylum in the face of persecution,” listing the obstacles to the right to asylum as the problem of bindingness, uncertainty as to whom the right to asylum is granted, and difficulty in accessing the right to asylum. Assoc. Prof. Dr. Arzu Güler stated, “Asylum is an institution of protection that states will provide if they wish. Accepting or rejecting an asylum application is within the sovereign rights of states.”

## **Reyhan Elmazovska: “There are 34 million refugee children in the world”**

** **Reyhan Elmazovska from Üsküdar Üniversitesi, in her presentation titled “The Invisible Face of Migration: Children,” drew attention to the fact that women and children are most affected by the difficulties and devastations encountered in transit countries while reaching the destination country. Elmazovska noted that, according to UN data, the number of refugee children under 18 in need of protection worldwide is 34 million, adding, “At this point, there is no doubt that the biggest blow is taken by lost and continuously disappearing refugee/migrant children. Violations of rights to life, health, and education especially affect children.”
